What happened
VA launched the VA Partial Claim Program on June 15, 2026, and it is open for submissions. That doesn't mean your servicer offers it yet. VA's consumer page says servicers have until November 28, 2026, to add partial claims to their systems. VA's servicer FAQ explains where that date comes from: servicers get 180 days to implement, counted from June 1, 2026, when VA published the final policy in its servicer manual (M26-4). VA also says a servicer can offer a partial claim only through its loss mitigation waterfall, and the two have to be implemented together.
Who it affects
Homeowners who are behind on a VA-guaranteed loan for the home they live in. You first have to complete a three-month trial payment plan. If you got a partial claim on the same loan under a COVID-era program, VA's FAQ says you can't get this one.
How it works
Once you finish the trial, the servicer pays the overdue amount and brings the loan current, and VA reimburses the servicer. VA takes a secured interest in your home that ranks behind the rest of your mortgage balance. VA says it generally does not require immediate repayment; you pay it back when the mortgage is paid off or refinanced, or when the home is sold. The law caps it at 25% of the unpaid principal balance, or 30% for a default in the March 1, 2020 to May 1, 2025 window; VA's servicer FAQ says the limit that applies is based on the due date of the current, uncured default. It is still a debt. Under the statute, a borrower who defaults is liable to VA for any loss that results, and VA's Circular 26-26-2, dated August 11, 2026, explains when a non-judicial foreclosure discharges the property from VA's partial claim interest, in states that allow one.
What to do now
Call your servicer and ask for the VA Partial Claim by name. If they tell you it isn't available yet, ask when their system will be ready, point out VA's November 28 date, and ask them to review you now for repayment plans, special forbearance and modifications. If you can't reach a resolution, call a VA loan technician at 877-827-3702 and select 6 (TTY: 711), Monday through Friday, 8:00 a.m. to 6:00 p.m. ET. We're a referral service, not a lender or servicer. Our VA Partial Claim Program guide covers the details.
